This Privacy Policy explains how MAMMOTIX TECHNOLOGIES PRIVATE LIMITED(“BharatCaller”, “we”, “us” or “our”) collects, uses, shares and protects your personal data when you use BharatCaller, our two-sided freelance marketplace. We act as a Data Fiduciary in respect of your personal data.
We handle your personal data in accordance with the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and other applicable Indian law. By using the Platform, you consent to the practices described here.
1. Personal data we collect
We collect the following categories of personal data:
- Account data — name, email address, phone number, password (stored in hashed form), role (client or freelancer) and profile details such as skills, rate and portfolio.
- Verification (KYC) data — identity and address details, and where required government-issued identifier information, collected to verify providers before they withdraw earnings and to meet legal obligations.
- Payment data — details needed to collect and disburse staged milestone payments. Full card or bank credentials are handled by our regulated payment partner, not stored by us.
- Engagement data — job briefs, proposals, connects usage, messages, negotiation records, milestone approvals, receipts (prefixed “GLD-”), reviews and Job Success Scores.
- Professional-connect basics — where you choose to connect a professional profile (such as LinkedIn) to enrich your account, only the basic profile fields you authorise. We do not deep-sync or scrape your professional network.
- Technical data — IP address, device and browser type, and usage logs collected automatically to keep the Platform secure and working.
2. How and why we use your data
We process your personal data for these purposes:
- To create and manage your account and provide the marketplace — matching, proposals, AI-assisted negotiation, messaging and reviews.
- To operate staged, escrow-style milestone payments and issue receipts and tax documents.
- To verify identity, prevent fraud, enforce our Terms of Use, and keep the Platform safe.
- To provide support and to respond to your queries and grievances.
- To comply with legal, regulatory and tax obligations under Indian law.
- To improve the Platform and, where you have consented, to send you service-related and marketing communications you can opt out of.
3. Our lawful basis
We process personal data on the basis of your consent, and, where applicable under the DPDP Act, for certain legitimate uses — such as performing the service you have requested, meeting a legal obligation, or preventing fraud. You may withdraw your consent at any time as described in Section 6; doing so will not affect processing already carried out and may limit your ability to use parts of the Platform.
5. Data retention and security
We retain personal data for as long as your account is active and for the period necessary to fulfil the purposes above, resolve disputes, and meet legal, tax and accounting obligations, after which it is deleted or anonymised. We apply reasonable technical and organisational security safeguards — including encryption in transit, access controls and hashing of passwords — to protect your data against unauthorised access, loss or misuse.
6. Your rights as a Data Principal
Under the DPDP Act you have the right to:
- Access a summary of the personal data we hold about you and how we process it.
- Request correction, completion or updating of inaccurate or incomplete data.
- Request erasure of your personal data where it is no longer needed and no legal obligation requires us to retain it.
- Withdraw consent you have given, as easily as you gave it.
- Nominate another individual to exercise your rights in the event of death or incapacity.
- Grievance redressal — raise a complaint with our Grievance Officer, and escalate to the Data Protection Board of India if it is not resolved.
To exercise any of these rights, contact us using the details in Section 9. We may need to verify your identity before acting on a request.
7. Children's data
The Platform is intended for users aged 18 and over. We do not knowingly process the personal data of children. If we learn that we have collected data from a child without verifiable parental consent, we will delete it.
8. Changes to this policy
We may update this Privacy Policy to reflect changes in our practices or the law. We will revise the “Last updated” date above and, for material changes, take reasonable steps to notify you.
